Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CoastClear platform, operated by zkflow.ai (“we,” “us,” “our”). By accessing CoastClear, you agree to these Terms. If you do not agree, do not use the service.
1. Eligibility
CoastClear is a professional tool for licensed real estate agents, brokers, and related real estate professionals operating in Florida. To use this service you must:
- Be at least 18 years of age
- Hold a valid Florida real estate license or work under the direct supervision of a licensed professional
- Have an approved account on our email allowlist
- Use the platform only for lawful professional purposes
2. Account
Access is restricted to users authorized on our email allowlist. We use magic link authentication — no passwords are stored. You are responsible for the security of your email account and any activity that occurs under your CoastClear account. Notify us immediately at support@zkflow.ai if you believe your account has been compromised.
Account credentials are personal and non-transferable. Sharing access credentials is grounds for immediate termination.
3. Data Accuracy Disclaimer
Property data is sourced from public records. It is provided for informational purposes only.
CoastClear aggregates data from Okaloosa and Walton County property appraiser records, FEMA National Flood Hazard Layer (NFHL), Florida Department of Environmental Protection databases, U.S. Census Bureau data, and other public sources. While we work to keep data current, it may be incomplete, outdated, or contain errors inherent to the source.
CoastClear reports are not:
- A substitute for a title search or title insurance commitment
- A certified property appraisal or broker price opinion
- An official FEMA flood determination — use a Flood Determination Certificate or LOMA/LOMR for transactions requiring official flood status
- Legal, financial, tax, or investment advice
- A guarantee of data accuracy, completeness, or fitness for any particular purpose
Always verify critical information with official county, state, and federal sources before making or advising on real estate decisions. You assume full responsibility for any reliance on CoastClear data.
4. Acceptable Use
You may use CoastClear reports and data to support your professional real estate practice. You may not:
- Resell, sublicense, publish, or redistribute CoastClear reports or the underlying data to third parties
- Scrape, crawl, or automated-query the platform beyond normal professional use
- Reverse-engineer, decompile, or attempt to extract the underlying data models or proprietary compilations
- Use the service to facilitate any unlawful activity, including violations of the Fair Housing Act, FCRA, or applicable Florida real estate law
- Share your account credentials with any other person or entity
- Use the service in any way that could damage, disable, or impair CoastClear infrastructure
5. Subscription & Billing
Subscription pricing and billing terms will be provided at the time you are offered a paid plan. Key terms that will apply:
- Subscriptions are billed on a recurring monthly or annual basis
- Florida law requires clear disclosure of auto-renewal terms — you will receive written notice before any renewal charge
- You may cancel at any time; access continues through the end of your paid billing period
- Refund policy will be specified in your subscription agreement
Payment processing is handled by Stripe. We do not store payment card numbers.
6. Intellectual Property
The CoastClear platform, interface, design, software, and compiled data products are owned by zkflow.ai and protected by applicable copyright and intellectual property law. You receive a limited, non-exclusive, non-transferable license to access and use the platform for your professional practice during your subscription term.
Underlying source data from government agencies (county property records, FEMA, U.S. Census Bureau, FL DEP, FCC) are public records and remain in the public domain. CoastClear's proprietary interest is in the compilation, enrichment, and presentation layer.
7. Limitation of Liability
To the maximum extent permitted by Florida law:
- CoastClear and zkflow.ai are provided “as is” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy
- We are not liable for any damages — direct, indirect, incidental, consequential, or punitive — arising from your use of or reliance on CoastClear reports or data, including any real estate transaction decisions
- Our total aggregate liability to you for any claim arising from use of the service is limited to the amounts you paid us in the 12 months preceding the claim
8. Indemnification
You agree to indemnify, defend, and hold harmless zkflow.ai, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any third-party right, including any property rights, privacy rights, or professional licensing obligations; or (d) any real estate transaction or advice in which CoastClear data was used.
9. Termination
We may suspend or terminate your access at any time, with or without notice, for: violation of these Terms, non-payment, conduct that may harm CoastClear or other users, or any business reason. Upon termination, your right to access the platform ends immediately.
You may terminate your account at any time by contacting support@zkflow.ai.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Okaloosa County, Florida, and you consent to personal jurisdiction in those courts.
11. Changes to These Terms
We may update these Terms at any time. For material changes, we will provide at least 30 days' notice via email to your registered address before the changes take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms.
